On 5 May 2020, Germany's Federal Constitutional Court (FCC) delivered a decision that will echo for years to come. The judgement on the legality of the ECB’s decisions on the Public Sector Purchase Programme (PSPP) has been delivered after the Weiss European Court of Justice (ECJ) ruling of 2018 and declared the ECJ judgment as being ultra vires in Germany. The recent FCC decision has raised important legal, economic and political concerns such as:
How will the FCC ruling impact on the ability of the ECB to pursue its monetary policy strategy? What consequences will it have on the ECB measures adopted in the context of the COVID-19 pandemic? Which will be the impact of such a decision in other fields of EU law and from an EU economic integration perspective? Will the relationship between the ECJ and national courts change and will the primacy of EU law further questioned?
